I told y'all. He swung. There is no maybe, it was out front and he just admitted it. It does not matter if he was just trying to get out of the way.

You know there really isn't a rule for check swings. It's totally up to the umpire.
There kinda is a rule, one we've known about for 50 years. If the bat travels through the hitting zone and the bat head tips past the plate and into the field of play, it's generally always called a strike.

So whatever you think you're accomplishing with this? You aren't. He swung.
